This privacy notice, (“Privacy Notice”) sets out how we (as defined below) collect, handle, use, store and/or process (together “Process”) personal data and/or sensitive personal data (together “Data”) you may share with us and/or that we may receive about you and/or another person in connection with a programme intended to be produced by us.
As a data controller (i.e. the organisation that Processes your Data), we will Process your Data in accordance with the General Data Protection Regulation (“GDPR”) and all other applicable data protection and/or privacy laws relating thereto, as amended or replaced from time to time (together the “Data Protection Laws”).

About the Programme
References to “Programme” in this Privacy Notice shall mean the development, programme and/or series you have applied for or been approached to appear in and/or any re-edited, re-voiced, reformatted, updated or compilation or any other versions thereof or further series or spin-offs and/or other content (collectively the “Programme”).
Consent for Processing Data
If you want to be considered for the Programme, you will be asked to provide consent to us in relation to the processing of the sensitive personal data you provide to us as part of your application (for the purpose of casting for the Programme). Sensitive personal data is Data which falls into the categories listed at (f)-(m) below.
You may also be offered the opportunity to consent to receiving Marketing Communications from us in relation to casting for other programmes.
What types of Data do we collect?
If you are interested in applying for and/or taking part in the Programme, as a contributor, we ask that you provide us with certain Data (the “Application”). The Data you share with us as part of the Application can include your:
(a) name;
(b) contact details (e.g. address, email address and/or phone number);
(c) gender;
(d) appearance (including an image of you);
(e) interests;
(f) dating preferences/sexual life;
(g) racial and/or ethnic background;
(h) health data;
(i) political opinion;
(j) religious or philosophical beliefs;
(k) trade union membership;
(l) genetic data;
(m) criminal history data; and
(n) biometric data.
In addition to the Data you submit as part of the Application, we may contact you to request further information and/or Data.
Purposes and lawful bases of the Processing of your Data
We Process the Data provided in the Application and any additional Data provided or collected during the Application process for the following purposes:
(a) Where necessary for our legitimate interests, as listed below, and where our interests are not overridden by your data protection rights:
(i) to assess your suitability to take part in the Programme and if successfully chosen, for any purposes we may reasonably require in order to develop, cast, produce, distribute and/or market the Programme and any associated online content, publicity, promotion and/or distribution materials. There may be additional terms and conditions that apply to the casting of a specific Programme so please read these carefully before you submit your Application;
(ii) to communicate with you about your Application;
(iii) to use your Data in connection with legal claims, compliance, regulatory and investigative purposes (including disclosure of such Data in connection with legal process or litigation); and
(iv) to analyse and monitor the diversity of our applicants in accordance with applicable laws.
(b) Where necessary to establish the contributor agreement or take steps linked to this agreement;
(c) Where you give us consent:
(i) In respect of any sensitive personal data that you provide to us as part of the Application process in order to assess your suitability for a Programme;
(ii) In respect of offers, promotions, publicity, information, news and/or updates and/or other marketing communications (“Marketing Communications”): as part of the Application or otherwise, you may also have the option to choose whether or not you wish to receive Marketing Communications from us by email and/or on behalf of the commissioning broadcaster of the Programme; our specially chosen partners; and/or sponsors in the entertainment, media and leisure sectors;
(iii)In respect of casting for other programmes: if you have indicated that you wish to be considered for casting of other programmes intended to be produced by us or our affiliate companies, then we may share certain Data, such as your name, email address and/or any other such chosen method of communication with the development and/or production teams, commissioning broadcasters, insurers and/ or distributors.
(d) For purposes which are required by law. This includes:
(i) Health and Safety: we may use your Data to assist with reasonable adjustments required, risk assessments necessary for you appearing in the Programme or for the purposes of fact checking your Application.
If required, we will ask for your consent before using your Data for a purpose other than those set out in this Privacy Notice.
Who will we share your Data with?
We may also share your Data (including sensitive personal data) with other companies, organisations and/or individuals for the purposes of (i) our internal business operations (including sharing Data with service providers); (ii) operating our website (including sharing Data with service providers); (iii) the casting, development, production and/or distribution of the Programme (including sharing Data with the production team, co-producers, the commissioning broadcaster, investors, insurers, distributors, IT system suppliers and/or travel and medical service providers); and/or (iv) complying with our obligations under any applicable laws and/or as required by a court.
In respect of Marketing Communications: if you have indicated to us on your Application that you wish to receive Marketing Communications, then we can share certain Data such as your name, email address and/or any other chosen method of communication with other companies, organisations and/or individuals.
In respect of casting for other programmes: if you have indicated to us that you wish to be considered for casting of other programmes, then we can share certain Data such as your name, email address and/or such other chosen method of communication with the development and/or production teams, commissioning broadcasters, insurers and/or distributors.
Any companies, organisations and/or individuals, with whom we can share your Data, will be required to comply with the Data Protection Laws and/or other applicable laws. Where we share your Data, we will put in place appropriate technical and organisational procedures designed to safeguard such Data.
How long do we keep your Data?
a) Application for the Programme: Unless archived for historical research purposes, any Data you share with us as part of the Application will be kept for up to three (3) years, unless you provide your consent to retain the Data for a longer period (e.g. to be considered as a potential contributor for other Programmes).
In the event that you are selected as a contributor and take part in the Programme, your Data will be kept for as long as the Programme is being broadcast, distributed and/or exploited (sometimes this may be in perpetuity).
b) Marketing Communications: If you have indicated to us on your Application that you wish to receive Marketing Communications, then your Data will be kept until such time as you notify us that you no longer wish to receive any Marketing Communications.
c) Casting for other Programmes: If you have indicated to us on your Application that you wish to be considered for casting of any of our other Programmes, then your Data will be kept until such time as you notify us that you no longer wish to be considered for our other Programmes.
Can we change how we Process your Data? We reserve the right to make changes to this Privacy Notice at any time without prior notice. However, we will notify you if we make substantial changes to this Privacy Notice. We will Process Data in accordance with the current Privacy Notice displayed.
How can you access the Data we hold about you?
You have the right to obtain a copy of the Data we hold about you in line with the Data Protection Laws. If you would like to obtain a copy of your Data, please contact us using the details set out at the end of this Privacy Notice.
What about the links to other websites, including to social media platforms, on the website?
If you have submitted your Application to us via the website, please be aware that the website may contain links to other websites, including social media platforms. Please note that we are not responsible for the practices of other websites, including their privacy practices. We recommend that you also read the privacy notices of other websites.
Who can you contact about your Data and/or this Privacy Notice?
If you would like to:
(i) change, update, correct and/or access your Data, or in certain circumstances, request that your Data be erased, restricted and/or withdraw your consent for us to Process your Data;
(ii) notify us that you no longer wish to be considered as a potential contributor (provided you’ve not already taken part in the Programme);
(iii) amend, update, restrict, remove your Data for Marketing Communications, for casting of other programmes and/or other purposes previously agreed by you; and/or
(iv) submit any queries concerning this Privacy Notice and/or how we Process your Data;
